ProudCamel NFT Terms and Conditions

1. Introduction

By purchasing, owning, or utilizing any ProudCamel NFT ("PCNFT") from ProudCamel, you agree to be legally bound by these Terms and Conditions ("Terms").

2. Eligibility

You represent and warrant that you are of legal age to form a binding contract (at least 18 years old in most jurisdictions) and are not a person barred from purchasing or owning digital assets under the laws of your country of residence.

3. Ownership and Licensing

Upon purchasing a PCNFT, you acquire a limited, non-exclusive, royalty-free, worldwide license to use, display, and distribute the associated digital content. You do not acquire any copyright or other intellectual property rights in the content. ProudCamel NFTs include a royalty mechanism, whereby a percentage of future sales will be paid to the original creator, as defined in the smart contract.

4. Usage Restrictions

You agree not to use the PCNFT or associated content for any unlawful purposes or in any way that violates these Terms. You also agree not to modify, disassemble, reverse engineer, or create derivative works based on the PCNFT or associated content.

5. No Warranty

PCNFTs and associated content are provided "as is" without any warranty of any kind, express or implied. ProudCamel does not guarantee the quality, authenticity, or rarity of PCNFTs and disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

In no event shall ProudCamel or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of PCNFTs or associated content.

7. Indemnification

You agree to indemnify, defend, and hold harmless ProudCamel and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of PCNFTs and associated content.

8. Amendments

ProudCamel reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice before the new terms take effect. Your continued use of PCNFTs or associated content constitutes your acceptance of the amended Terms.
